We take privacy seriously. This notice tells you who we are, what information about you we collect, and what we do with it. Click on “find out more” in each section for further information.

Who are we?
We are a member of Philip Morris International. Our details (name, address, etc.) will have been given to you separately at the time of (or to confirm) the collection of information about you, for example, in a notice on an app or a website, or in an e-mail, containing a link to this notice.

- PMI affiliates: Each member of the Philip Morris International group of companies is a “PMI affiliate”. “We” (or “us” or “our”) refers to the PMI affiliate that first collected information about you.
- PMI product: means a product of ours or of another PMI affiliate.
How do we collect information about you?
We may collect information about you in various ways.
- You may provide us with information directly (e.g. filling in a form, or making a call to us).
- We may collect information automatically (e.g. when you use a PMI app or website).
- We may acquire information from third parties (e.g. publicly-available information on social media platforms such as Facebook and Twitter).
In this notice, we refer to all the methods by which you are in contact with us as “PMI touchpoints”. PMI touchpoints include both physical (for example, retail outlets and events), and digital (for example, apps and websites).

We may collect information that you provide directly. Typically this will happen when you:
- sign up to be a member of our databases (this could be, for example, in person, via app, or online);
- purchase PMI products or services at a retail outlet;
- download, or use, a digital touchpoint (e.g. an app or a website);
- contact us through a touchpoint, or by e-mail, social media or telephone;
- register a device with us;
- subscribe to a PMI panel portal;
- register to receive PMI press releases, e-mail alerts, or marketing communications;
- participate in PMI surveys or (where permitted by law) PMI competitions or promotions; or
- attend an event that a PMI affiliate has organised.
We may collect information about you automatically. Typically this will happen when you:
- visit an outlet that sells PMI products (e.g. by collecting your data at check-out, or through sensors at the outlet that connect with mobile technology);
- attend an event that a PMI affiliate has organised (e.g. through purchases at the event or through sensors at the event that connect with mobile technology);
- communicate with us (for example, through a touchpoint; or social media platforms);
- use PMI touchpoints (e.g. through tracking mechanisms in an app or a website); or
- make public posts on social media platforms that we follow (for example, so that we can understand public opinion, or respond to requests concerning PMI products).
We may also collect information about you automatically through the use of cookies and similar tracking technologies on digital PMI touchpoints. The specific cookies and technologies used will depend on the PMI touchpoint in question. To learn about the cookies (including Google analytics cookies) and similar technologies used on a touchpoint, including how you can accept or refuse cookies, please see the cookie notice made available on or through that touchpoint.
Where permitted by law, we may acquire information about you from third parties. This may include information shared between PMI affiliates, publicly-available profile information (such as your preferences and interests) on third party social media sites (such as Facebook and Twitter), and marketing lists acquired from third party marketing agencies.
We may also collect information in other contexts made apparent to you at the time.
What information about you do we collect?
We may collect various types of information about you:
- information necessary to fulfil your orders
- information necessary to provide warranty services
- information you give us in forms or surveys
- information about your visits to our outlets and events
- information you give us in calls you make to call centres
- information about your preferences and interests
- information necessary to verify your age

Information that we collect from you directly will be apparent from the context in which you provide it. For example:
- if you order a product from us through a touchpoint, you provide your name, contact, billing details, and the products you have chosen so that we can fulfil your order;
- you may provide information on your product preferences and interests so that we can offer you products and services that will interest you;
- if you make an appointment to see us (or someone supporting our products or services), we may collect your name and contact details;
- we may collect information that enables us to verify your age, for example a copy of an identity document or your facial image.
Information that we collect automatically will generally concern:
- details of your visit or call (such as time and duration);
- in a sales outlet or at an event (including areas in the immediate vicinity), how frequently you visit, which areas you visit and for how long, and which purchases you make;
- your use of digital PMI touchpoints (such as the pages you visit, the page from which you came, and the page to which you went when you left, search terms entered, or links clicked within the touchpoint); and
- your device (such as your IP address or unique device identifier, location data, details of any cookies that we may have stored on your device).
Information that we collect from third parties will generally consist of publicly-available profile information (such as your preferences and interests), for example from public social media posts.
For what purposes do we use information about you, and on what legal basis?
In this section, we describe the purposes for which we use personal information. However, this is a global notice, and where the laws of a country restrict or prohibit certain activities described in this notice, we will not use information about you for those purposes in that country.
Subject to the above, we use information about you for the following purposes:
- To comply with regulatory obligations, such as verifying your age and status as a user of our products
- To sell our products to you, including fulfilling your orders, processing your payments
- To provide sales-related services to you, including dealing with your inquiries and requests, and providing warranty services
- To market our products (where permitted by law), including administering loyalty programs, product improvement, market research, developing marketing strategies, administering marketing campaigns, and customizing your experiences at outlets that sell PMI products and at events
- For us or our business partners to inform you of potential opportunities to get involved in marketing or promoting PMI products
- To support all the above, including administering your accounts, enabling you to use PMI touchpoints, corresponding with you, managing your appointments with us or with someone supporting our products or services (for example, regarding a new product, or after-sales service), customizing your experiences of PMI touchpoints, and administration and troubleshooting
- For business analytics and improvements, including improving PMI products, outlets and events, and the information that we (or our affiliates) provide to our customers
- For other purposes that we notify you of, or will be clear from the context, at the point information about you is first collected
The legal basis for our use of information about you is one of the following (which we explain in more detail in the “find out more” section):
- compliance with a legal obligation to which we are subject;
- the performance of a contract to which you are a party;

In certain countries, where required by law, we will send you these materials in electronic format only with your consent.

We use it on the grounds that correspond to the purpose for using the information that we are supporting. For example, where we administer your account to support a purchase or to provide after-sales service, we use the information to discharge our contractual obligations to you as a buyer of our products; where we administer your account to show you our products, we are supporting marketing and so we use it on the grounds that we have a legitimate business interest to market our products that is not overridden by your interests, rights and freedoms to protect information about you, and so on.
Business analytics and improvements

This will typically be a combination of information that you provide to us; information that we collect automatically; and (where permitted by law) information that we acquire from third parties.
We use it on the grounds that we have a legitimate business interest to analyze and to improve our business performance, our products, PMI touchpoints, outlets and events, and to invite others to get involved in promoting PMI products, that is not overridden by interests, rights and freedoms to protect information about you.
Where we do not base our use of information about you on one of the above legal bases, we will ask for your consent before we process the information (these cases will be clear from the context).
In some instances, we may use information about you in ways that are not described above. Where this is the case, we will provide a supplemental privacy notice that explains such use. You should read any supplemental notice in conjunction with this notice.
Who do we share your information with, and for what purposes?
We may share information about you with:
- PMI affiliates;
- third parties who provide PMI affiliates or you with products or services;
- PMI affiliates’ carefully selected business partners and advertisers (in areas connected with our products, or consistent with their style and image) so that they can contact you with offers that they think may interest you, in accordance with your preferences; and
- other third parties, where required or permitted by law.

Sharing data with other PMI affiliates
- Information about you will be shared with Philip Morris International Management SA (based in Lausanne, Switzerland), which is the place of central administration of personal data processing for PMI affiliates. Philip Morris International Management SA processes the information about you for all the purposes described in this notice.
- Information about you may be shared with the PMI affiliate that is responsible for the country in which you live (if it wasn’t the PMI affiliate that first collected the information) for all the purposes described in this notice.
- Information about you may be shared with any other PMI affiliate that you contact (for example, if you travel and you want to know where to buy PMI products in a new country, or where to find service or support for PMI products) in order to enhance our service to you.

Sharing data with Third Parties
- We may share information about you with third parties who provide PMI affiliates or you with products or services (such as advisers, payment service providers, delivery providers, retailers, product coaches, information services providers and age verification providers).
- We may share information about you with PMI affiliates’ carefully-selected third party business partners and advertisers (in line with the kind of thing you might associate with our products, for example because they have similar or complementary image, style, or functionality) so that they can contact you with products, services and promotions that they think may interest you, in accordance with your preferences.
- We may share information about you with other third parties, where required or permitted by law, for example: regulatory authorities; government departments; in response to a request from law enforcement authorities or other government officials; when we consider disclosure to be necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity; and in the context of organisational restructuring.
Where might information about you be sent?
As with any multinational organisation, PMI affiliates transfer information globally. Accordingly, information about you may be transferred globally (if your information is collected within the European Economic Area, this means that your information may be transferred outside it).

When using information as described in this notice, information about you may be transferred either within or outside the country or territory where it was collected, including to a country or territory that may not have equivalent data protection standards.
For example, PMI affiliates within the European Economic Area (“EEA”) may transfer personal information to PMI affiliates outside the EEA. In all cases, the transfer will be:
- on the basis of a European Commission adequacy decision;
- subject to appropriate safeguards, for example the EU Model Contracts; or
- necessary to discharge obligations under a contract between you and us (or the implementation of pre-contractual measures taken at your request) or for the conclusion or performance of a contract concluded in your interest between us and a third party, such as in relation to travel arrangements.
In all cases, appropriate security measures for the protection of personal information will be applied in those countries or territories, in accordance with applicable data protection laws.
How do we protect information about you?
We implement appropriate technical and organisational measures to protect personal information that we hold from unauthorised disclosure, use, alteration or destruction. Where appropriate, we use encryption and other technologies that can assist in securing the information you provide. We also require our service providers to comply with strict data privacy and security requirements.
How long will information about you be kept?
We will retain information about you for the period necessary to fulfil the purposes for which the information was collected. After that, we will delete it. The period will vary depending on the purposes for which the information was collected. Note that in some circumstances, you have the right to request us to delete the information. Also, we are sometimes legally obliged to retain the information, for example, for tax and accounting purposes.

Typically, we retain data based on the criteria described in the table below:

Most of the information in your marketing profile is kept for the duration of our marketing relationship with you; for example, while you continue to use digital touchpoints, or respond to our communications. However, some elements of your marketing profile, such as records of how we interact with you, naturally go out of date after a period of time, so we delete them automatically after defined periods (typically 3 years) as appropriate for the purpose for which we collected them.
- marketing to you (including marketing communications) (if you are no longer in contact with us)
This scenario is the same as the above, but if we don’t have any contact with you for a long period (typically 2 years), we will stop sending you marketing communications and delete your history of responses to them. This will happen, for example, if you never click through to an invitation to an event, log on to a digital touchpoint, or contact customer care, during that time. The reason is that in these circumstances, we assume you would prefer not to receive the communications.
- marketing to you (including marketing communications) (if you are not contactable)
If you have registered to receive marketing communications, but the information you give us to contact you doesn’t work, we will retain your details for a period of typically only 6 months to allow you to return and correct it.
- marketing to you (including marketing communications) (incomplete registrations)
If you commence registering yourself in a database, but do not complete the process (for example, if you don’t complete the age verification process, or you don’t accept the touchpoint’s terms of use), we will retain your details for only 6 months to allow you to return and complete the process.
- market research
If you are not registered with us for other purposes (e.g. marketing communications, warranty, customer care), and we use publicly available information about you in order to understand the market or your preferences, we will retain the information about you for a short period in order to perform the particular item of market research.
- purchases and warranty
If you purchase goods, we will retain details of this for so long as required to complete the sale, and to comply with any legal obligations (for example, for tax and accounting record-keeping purposes). If you also register for a warranty for a device, we will retain details of this for so long as relevant to the warranty.
- customer care
If you contact customer care, we will make a record of the matter (including details of your enquiry and our response) and retain it while it remains relevant to our relationship, for example if you need us to replace a device under warranty, or if your recent enquiries are relevant. Temporary records (for example, an automated recording of a telephone call in which you ask us to direct you to a retail outlet) may be relevant only until more permanent records are made, and will be retained only temporarily.
- system audit logs
System audit logs are retained typically for a period of only a few months.
- business analytics
Business analytics data is typically collected automatically when you use PMI touchpoints and anonymised/aggregated shortly afterwards.
What rights and options do you have?
You may have some or all of the following rights in respect of information about you that we hold:
- request us to give you access to it;
- request us to rectify it, update it, or erase it;
- request us to restrict our using it, in certain circumstances;
- object to our using it, in certain circumstances;
- withdraw your consent to our using it;
- data portability, in certain circumstances;
- opt out from our using it for direct marketing; and
- lodge a complaint with the supervisory authority in your country (if there is one).
We offer you easy ways to exercise these rights, such as “unsubscribe” links, or giving you a contact address, in messages you receive.
Some mobile applications we offer might also send you push messages, for instance about new products or services. You can disable these messages through the settings in your phone or the application.

This applies if:
- the information we hold is no longer necessary in relation to the purposes for which we use it;
- we use the information on the basis of your consent and you withdraw your consent (in this case, we will remember not to contact you again, unless you tell us you want us to delete all information about you in which case we will respect your wishes);
- we use the information on the basis of legitimate interest and we find that, following your objection, we do not have an overriding interest in continuing to use it;
- the information was unlawfully obtained or used; or
- to comply with a legal obligation.
- to request us to restrict our processing of it
This right applies, temporarily while we look into your case, if you:
- contest the accuracy of the information we use; or
- have objected to our using the information on the basis of legitimate interest
(if you make use of your right in these cases, we will tell you before we use the information again).
This right applies also if:
- our use is unlawful and you oppose the erasure of the data; or
- we no longer need the data, but you require it to establish a legal case.
- to object to our processing it
You have two rights here:
- if we use information about you for direct marketing: you can “opt out” (without the need to justify it) and we will comply with your request; and
- if we use the information about you on the basis of legitimate interest for purposes other than direct marketing, you can object to our using it for those purposes, giving an explanation of your particular situation, and we will consider your objection.
- to withdraw your consent to our using it
This applies if the legal basis on which we use the information about you is consent. These cases will be clear from the context.
- to data portability
If:
- you have provided data to us; and
- we use that data, by automated means, and on the basis either of your consent, or on the basis of discharging our contractual obligations to you,
then you have the right to receive the data back from us in a commonly used format, and the right to require us to transmit the data to someone else if it is technically feasible for us to do so.
- to lodge a complaint with the supervisory authority in your country
Each European Economic Area country must provide for one or more public authorities for this purpose.

- If you are in France, you have the right to give us instructions regarding information we hold about you in the event of your death (specifically, whether we should store or delete it, and whether others should have the right to see it). You may:
- issue general instructions to a digital service provider registered with the French data protection supervisory authority (called “CNIL”) (these instructions apply to all use of information about you); or
- give us specific instructions that apply only to our use of information about you.
Your instructions may require us to transfer information about you to a third party (but where the information contains information about others, our obligation to respect also their privacy rights might mean that we can’t follow your instructions to the letter). You may appoint a third party to be responsible for ensuring your instructions are followed. If you do not appoint a third party in that way, you successors will (unless you specify otherwise in your instructions) be entitled to exercise your rights over information about you after your death:
- in order to administer your estate (in which case your successors will be able to access information about you to identify and obtain information that could be useful to administer your estate, including any digital goods or data that could be considered a family memory that is transferable to your successors); and
- to ensure that parties using information about you take into account your death (such as closing your account, and restricting the use of, or updating, information about you).
You may amend or revoke your instructions at any time. For further information on the processing of information about you in the event of your death, see Article 40-1 of the law 78-17 dated 6 January 1978. When you die, by default, you will stop using your account and we will delete information about you in accordance with our retention policies (see the paragraph “How long will information about you be kept?” for details).
Who should you contact with questions?
If you have any questions, or wish to exercise any of your rights, you can find contact details for the relevant PMI affiliate, and if applicable data protection officer, pmi.com. Contact details will also be given in any communications that a PMI affiliate sends you.
If your country has a data protection authority, you have a right to contact it with any questions or concerns. If the relevant PMI affiliate cannot resolve your questions or concerns, you also have the right to seek judicial remedy before a national court.
Changes to this notice
We may update this notice (and any supplemental privacy notice), from time to time. We will notify you of the changes where required by law to do so.

These Regulations define the rules for using the services provided by the Service Provider as part of the website at veev-vape.com/pl/en (hereinafter the “Site”) as well as the conditions for concluding and terminating contracts, as well as the complaint procedure.
The Regulations are available on the Site in a form that allows them to be downloaded, recorded, saved, and printed.
1 DEFINITIONS
The following terms used herein shall have the meanings ascribed below:
1.Customer Service Centre - the channel for informing and servicing the Users made available by the Service Provider; the User may contact the Customer Service Centre by phone at: + 48 801 801 501 or 22 455 14 04, by sending an e-mail to the following address: contact.pl@iqos.com, or using the Messenger application available at: https://www.facebook.com/iqospl. The toll paid by the User for a telephone call to the Customer Service Centre is based on the price list of the User’s service provider.
2.User - an adult natural person with full legal capacity, residing in the territory of the Republic of Poland, using the Site under the conditions described in these Regulations.
3.Regulations - the present Regulations describing the terms and conditions of use of the Site and individual functionalities thereof.
4.Site - website intended for adult tobacco product users residing within the Republic of Poland, operated by PMPL-D at veev-vape.com/pl/en
5.Service Provider - Philip Morris Polska Distribution Sp. z o.o. with a registered office in Krakow at: Al. Jana Pawła II 196, 31-982 Kraków, entered into the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście, 11th Economic Division of the National Court Register under KRS no.: 289223, NIP no.: 675-137-33-54 with a share capital of PLN 10,000,000.00, telephone number: 801 801 501, e-mail address: contact.pl@myiqos.com.
6.Content/Contents - any text, graphic or multimedia elements (e.g. information about the Goods, photos, films, descriptions, and comments), including works within the meaning of the Copyright and Related Rights Act and representations of natural persons, which can be published and disseminated by the Service Provider and their contractors, respectively or by another person using the Site.
2 USE OF THE SITE
1.Use of the Site shall require that the device and computer system of the User meet the minimum technical requirements:
a.Internet connection;
b.latest version of IE, Edge, Chrome, FF, Opera, or Safari Internet browser;
c.enabled cookies;
d.enabled JavaScript;
e.recommended resolution: 320px, 480px, 768px, 992px, 1200px;
f.receiving e-mails requires possession of a computer, telephone, or other device with Internet access that allows to receive e-mails.
2.If the User uses hardware or software that does not meet the technical requirements set out in section 1 above, the Service Provider does not guarantee the proper functioning of the Site.
3.The Site shall be made available solely to adult persons using tobacco products who reside in the Republic of Poland, within the meaning of the applicable provisions of the Civil Law, and shall be managed via the veev-vape.com/pl/en website owned by the Service Provider.
4.Commencement of use of the Site shall mean acceptance of the terms and conditions defined herein.
5.The User may change and correct the data entered in the form made available on the Site at any time by contacting the Customer Service Centre.
6.Service Provider informs that while using the Website, short text information called “cookies” are saved in the User’s ICT system (on computer, phone or other device used to connect to the Site), which enable subsequent identification of the User in case of reconnection with the Website. Installing these “Strictly necessary cookies” is essential for the proper performance of the Service Contract. “Strictly necessary cookies” contain information necessary for the proper functioning of the Site. “Cookies”: performance cookies and cookies related to advertisements and their recipients, collect data on the use of the Site by the User, and their main purpose is to facilitate the User’s use of the Site, adapting the Site’s pages to the User’s needs and expectations, and examining traffic within the Site. By clicking on the “Accept all” option on the consent banner at the bottom of veev-vape.com/pl/en page (“Banner”), you agree that we may present you with services, advertising and promotional campaigns that will be tailored to your preferences. Matching is based on the processed personal data collected in connection with the user’s activity on websites, based on the personal data present there. By clicking the “Learn more” button on the Banner or the “Reject All” button below, you can change or withdraw your consent accordingly.
7.Cookies are used on the Site with the consent of the User. Consent may be expressed using a “cookies” banner displayed when opening the Site and after opening the banner through the link in the footer hidden under the word “Cookies”. The User may restrict or disable cookies in their browser at any time. In such a case, it may happen that the use of the Site will be less efficient, the User will not have access to some content and in extreme cases, the proper display of the Site pages may be completely blocked.
8.Pursuant to the Act of 9 November 1995 on Protection of Health Against the Consequences of Consumption of Tobacco and Tobacco Products, it shall be prohibited to carry out any advertising and promotional activities not complying with the generally applicable law, particularly smokers’ requisites and tobacco products, while using the Site.
9.The data provided by the Users within the scope of using the Site are cryptographically secured with SSL protocol. Any events affecting the security of information transmission should be reported to the Service Provider at the following address: contact.pl@iqos.com. It is recommended to use up-to-date antivirus software on the device through which the User connects to the Site.
3 SCOPE OF SERVICES
1.The Service Provider shall provide, in particular, the following services to the Users free of charge:
a.enabling Users to use the form to provide the Service Provider with personal and contact data for further User service.
b.enabling Users to familiarise themselves with the available products and choose a service channel.
2.The Service Provider shall undertake to render services specified in section 1 above within the scope and on the terms and conditions laid down herein. Using the services specified in section 1 above by the User shall not result in the obligation thereof to make payment of the price to the Service Provider.
3.The condition for using the services indicated in section 1 above is that the terminal device and the ICT system used by the User meet the minimum technical requirements set out in § 2 section 1 of the Regulations.
4.The User shall in particular take advantage of the services offered by the Service Provider via the Site in accordance with binding laws, provisions of the Regulations, as well as the customs and principles of social coexistence, including in a manner that is not burdensome for other Users and the Service Provider and not disrupting the Service Provider’s operations.
5.The User shall also:
a.not provide, nor transfer any Contents prohibited by the provisions of applicable law;
b.refrain from the following:
(i)creating more than one Account,
(ii)submitting false or outdated information or data, including personal data,
(iii)attempting to interfere with the code of the Website, disrupt the operation of the Website, or post illegal, vulgar content or one that violates the rights of third parties,
(iv)other material violations relevant to the operation and organisation of the Programme, including, in particular, the conduct of business for profit by the Participant with the use of the Programme or with reference to the Programme.
c.provide real personal data;
d.regardless of the actions taken by the Service Provider, update, as far as possible, personal data in the event of changes by contacting the Customer Service Centre;
e.provide a Polish telephone number (nine-digit, in accordance with the national numbering plan specified by the minister responsible for digitization).
6.Any breach of the obligations specified in sections 4 or 5 above shall be interpreted as a gross violation of these Regulations and may result in blocking the User, without informing them beforehand, from access to all or several services provided via the Site.
4 COMPLAINTS ABOUT THE SERVICES
1.The User shall at any time have the right to make complaints about the services rendered by the Service Provider.
2.The User may submit to the Service Provider a complaint regarding the services provided by the Service Provider by contacting the Customer Service Centre. In order to expedite the consideration of the complaint, the Service Provider recommends to provide in the complaint a brief description of the reasons justifying the complaint and contact details of the User submitting the complaint.
3.The complaint will be handled by the Service Provider within 30 days from its submission.
6 PERSONAL DATA
1.The Service Provider shall be the Controller of Personal Data processed as part of the Site.
2.Personal data processing shall be carried out pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”).
3.The Service Provider will process the following User data:

c.date of birth
d.telephone number
e.address details
f.country of residence
4.Personal data will be processed for the proper performance of services based on the legitimate interest of the Service Provider, based on the User’s consent for the purposes of contact and transfer of commercial information by the Service Provider. The Controller may also process Users’ personal data for other purposes solely on their instruction (particularly in order to process applications or complaints).
5.We store Users’ personal data for the purposes indicated in § 6 section 4 of the Regulations until an objection is raised against their processing for this purpose, consent to the processing of personal data is withdrawn, or we determine that personal data should be deleted or anonymised in accordance with the relevant retention periods for personal data.
6.The User shall have the right to access the content of their data, demand their rectification, deletion, limiting processing and the right to object against their processing, as well as the right to lodge a complaint with a supervisory body. The Participant also has the right to transfer personal data. The provision of data is voluntary, yet necessary for the achievement of the above described objectives. 7.The User has the right to withdraw consent at any time. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
8.The provision of personal data is voluntary. The consequence of not providing personal data, providing incomplete or even partially untrue or incorrect personal data is the inability to use the Site.
9.The Organiser declares that the data of the Participants will not be processed in an automated manner and will not be profiled.
10.The data of the Programme Participants shall be transferred to the Organiser’s subcontractors and entities authorised by law.
11.Your data is transferred to third countries (i.e. outside the European Economic Area, including the European Union, Norway, Liechtenstein, and Iceland).

7 COPYRIGHTS
The sole rights to the Contents made available / placed on the Site by the Service Provider or contractors thereof, in particular copyrights, graphic elements, software, and rights in regard to databases shall be encompassed by legal protection and awarded to the Service Provider or entities with whom they have entered into relevant contracts. The User is entitled to use the above-mentioned Contents free of charge, but only within the scope of permitted personal use and in accordance with the Regulations. Using Contents to a different extent shall be permissible only on the basis of an express, prior consent granted by an entity with the relevant right, in writing under pain of invalidity, and within the boundaries of commonly binding law.
8 AMENDMENTS TO REGULATIONS
1.The Regulations shall become effective on 26 June 2023 and shall be available on the Site.
2.The Service Provider reserves the right to modify the Regulations in the occurrence of at least one of the following valid causes (closed list):
a.amendments to the laws governing the provision of services via electronic means by the Service Provider which affect the respective rights and obligations laid down in the Service Contract entered into by the Service Provider and the User;
b.the need to adapt the activities carried out by the Service Provider to orders, rulings, decisions, or guidelines resulting from:
-any decision of the public authority competent to regulate the activities carried out by the Service Provider which affects the mutual rights and obligations laid down in the Service Contract entered into by the User and the Service Provider;
or
-any judicial ruling applicable to the activities carried out by the Service Provider which affects the mutual rights and obligations laid down in the Service Contract entered into by the User and the Service Provider;
c.modification of the manner of providing services electronically by the Service Provider which is olely due to technical or technological reasons (in particular, updating technical requirements);
d.any changes within the scope or terms of rendering services by the Service Provider which are covered by the provisions of the Regulations, by introducing new, modifying, as well as cancelling existing functionalities or services offered to the User and covered by the present Regulations.
3.If it is necessary to change the Regulations, the Service Provider will make its new version available on the Site, about which it will notify the User by posting the content of the Regulations and provisions that have changed on the main page of the Site. The amended version of the Regulations will enter into force no earlier than 14 days after the date of making its new version available and posting information about the change on the Site. Users registered on the Site will be additionally informed by e-mail about the change to the Regulations at least 14 days before the change enters into force, if it is justified by objective reasons.
As a rule, e-mail information will not be provided due to the fact that the Regulations apply only in the registration process. If the User who does not accept the change to the Regulations is obliged to inform the Seller about the lack of acceptance within 14 days from the date on which the information was introduced to the means of electronic communication in such a way that the person could read its content. The Regulations in the wording applicable as at the date of conclusion of the contract shall apply to the provision of Services.
9 FINAL PROVISIONS
1.The applicable law for implementing the terms, conditions, and principles of using the Site defined in the Regulations shall be the law of the Republic of Poland and the competent courts shall be common courts of the Republic of Poland, unless otherwise indicated by mandatory legal regulations.
2.Selecting Polish law pursuant to the Regulations shall not deprive the User of protection granted by virtue of provisions which cannot be excluded by way of a contract between the Service Provider and the User in accordance with the law which, pursuant to applicable regulations, would be the governing law in case no selection was made.
3.With regard to the information presented on the Site, which has been posted or provided by third parties, the Service Provider is not responsible for the up-to-dateness, accuracy or completeness of this information, as well as for its usefulness for any activities of the User.
4.The Service Provider is also not responsible for the User’s use of the Site in a manner contrary to the provisions of the Regulations, applicable law, or the provisions of contracts between the Service Provider and the User.
5.The User is responsible for any consequences resulting from the User’s improper completion of the forms available on the Site, in particular resulting from providing incorrect or untrue data by the User.
6.Disputes arising from the interpretation or implementation of the Regulations will be resolved by the court competent according to the law.

Most business analytics data is retained for the duration of our marketing relationship as described in point 10 a) above. Regulations of the “PMI Recycling” Programme
The Organiser of the "PMI Recycling" Programme - Philip Morris Polska Distribution Sp z o.o. with its registered office in Kraków - is committed to significantly reducing the amount of used Veev One pods and used Veev Now devices that end up in landfills, therefore to reusing and recycling them, which helps protect the environment and conserve natural resources.
The goal of the Organiser of the “PMI Recycling” Programme - Philip Morris Polska Distribution Sp z o.o. with its registered office in Kraków - is to ensure that all used Veev One device pods and used Veev Now devices collected under the Programme will be reused or disposed of in a way that does not threaten the environment (in accordance with Directive 2012/19/EU of the European Parliament and of the Council of 4 July 2012 on waste electrical and electronic equipment, the so-called WEEE Directive).
Philip Morris Polska Distribution Sp. z o. o. cooperates with organisations involved in organising the recovery process and an entity holding a waste processing permit, and is listed in the register of enterprises kept by the Marshals of the Voivodships (BDO).
Considering the above statements and commitments, Philip Morris Polska Distribution Sp. z o. o. with its registered office in Kraków, organised a programme addressed to adult users of tobacco products containing nicotine and established its following regulations:
§ 1
GENERAL PROVISIONS
1. These Regulations (hereinafter: “Regulations”) define the scope and conditions of the “PMI Recycling” programme (hereinafter: “Programme”) run by Philip Morris Polska Distribution Sp. z o. o. with its registered office in Kraków, 31-982 Kraków, Aleja Jana Pawła II 196, entered into the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register, under KRS number: 0000289223, with share capital in the amount of PLN 10,000,000.00, BDO [Waste Management Database] number: 000011337, telephone number: 801 801 501, e-mail address: contact.pl@myiqos.com (hereinafter: “PMPLD” or “Organiser”).
2. PMPLD runs the Programme under the conditions set out in the Regulations, independently or with the help of a partner, which is one of the following companies: a) Inmedio Services Sp. z o. o. with its registered office in Warsaw, Aleje Jerozolimskie 174, 02-486 Warsaw, b) Lagardere Travel Retail Sp. z o. o. with its registered office in Warsaw, Aleje Jerozolimskie 174, 02-486 Warsaw, or c) Swiat Prasy Sp. z o. o. limited joint-stock partnership with its registered office in Warsaw, ul. Piękna 18, 00-549 Warsaw (hereinafter: “Partner”). When running the Programme, the Partner acts on behalf of and for PMPLD, unless the Regulations clearly state otherwise.
3. The Programme is run by PMPLD with a dedicated claims process.
4. The Programme runs from 1 July 2023 until further notice. The Organiser will inform about the end of the Programme by publishing an announcement on the veev-vape.com website.
5. The Regulations are available on the website veev-vape.com and in every IQOS brick and mortar store in the territory of the Republic of Poland, where you can purchase the Veev One device (hereinafter: “Store”).
6. § 2
RULES OF THE PROGRAMME
- Participation in the Programme is available only to adult users of tobacco or nicotine-containing products (hereinafter: “Participant” or “Participants”) who:
- have an account in the Organiser’s consumer database (hereinafter: “Account”);
- agree to receive commercial information from the Organiser;
- register on their Account in the Organiser’s database the Veev One device purchased in the Republic of Poland, which they own (hereinafter: “Product”);
- they will hand over to an employee of the IQOS Store, a used VEEV One device, a used pod for the Veev One device or a used Veev Now device.
- When registering the Product on the Account, the Participant will be asked to provide the serial number of the Product, which consists of 14 characters and begins with the letter T.
- A map of stores indicating the locations where the Programme is implemented is available at veev-vape.com. They are listed in Annex 1 to these Regulations.
§ 3
PROCESSING OF PERSONAL DATA
- The Controller of personal data of Programme Participants is the Organiser.
- Personal data processing shall be carried out pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation “GDPR”).
- Personal data may be processed for the purpose of proper organisation and implementation of the Programme, including contact with Participants in matters related to the Programme, as well as for marketing purposes, which is the legitimate interest of the Organiser. Personal data will be processed for the duration of the Programme and also after its completion, if it is justified by the need to settle claims or due to legal provisions.
- Providing personal data and expressing consents is voluntary, but necessary to participate in the Programme.
- The Programme Participant shall have the right to access the content of their data, demand their rectification, deletion, limiting processing and the right to object against their processing, as well as the right to lodge a complaint with a supervisory body. The Programme Participant shall have the right to transfer personal data and in cases where the processing of data takes place based on a consent, to withdraw the consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
- The Organiser declares that the data of the Participants will not be processed in an automated manner and will not be profiled.
- The data of the Programme Participants may be transferred to the Organiser’s subcontractors and entities authorised by law.
- The Organiser will collect the following data from the Participants:
- first name;
- last name;
- date of birth;
- telephone number,
- e-mail address.
- Data of Entitled Consumers will not be transferred to third countries (i.e. outside the European Economic Area, including the European Union, Norway, Liechtenstein, and Iceland).
- Entitled Consumers may contact the Organiser if they have questions regarding the processing of personal data by the Organiser, using the following e-mail address: contact.pl@iqos.com.

§ 4
COMPLAINT PROCEDURE
- The Participant shall have the right to file a complaint regarding the Programme at any time.
- The Participant may file a complaint, in particular in the form of an e-mail or by telephone contact with the Customer Service Centre. In order to expedite the consideration of the complaint, the Organiser recommends to provide in the complaint a brief description of the reasons justifying the complaint, contact details of the Participant filing the complaint and the note “PMI RECYCLING PROGRAMME”.
- The complaint will be handled by the Organiser within 14 days from receipt by the Organiser of the complaint notice.
§ 5
FINAL PROVISIONS
- All matters not provided hereunder shall be governed by the provisions of Polish law, in particular the provisions of Polish Civil Code.
- Should any provision of the Regulations prove invalid or ineffective, the Regulations shall remain in full force with regard to the remaining provisions.

Terms & Conditions of the consumer program "Benefit for expressing marketing consent to Philip Morris Polska Distribution Sp. z.o.o and registering device"
TERMS AND CONDITIONS OF THE CONSUMER PROGRAM
§ 1
General Provisions
- Consumer Program “BENEFIT FOR EXPRESSING MARKETING CONSENT TO PHILIP MORRIS POLSKA DISTRIBUTION SP. Z O.O. AND REGISTERING THE DEVICE” (hereinafter referred to as the “Program”) is organised by Philip Morris Polska Distribution Sp. z o.o. with its registered office in Kraków at Al. Jana Pawła II 196, 31-982 Kraków, entered in the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register under KRS number 289223, NIP: 675-13-73-354, BDO: 000011337, with a share capital of PLN 10,000,000.00 (hereinafter referred to as “PMPL-D” or “Organiser”).
- The text of these Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) is available at www.rejestrujemysie.pl, www.iqos.com and www.veev-vape.com, in IQOS stationary stores as well as at IQOS Representatives and selected retail outlets. Users may also obtain information on these Terms and Conditions by contacting the Customer Service Centre at 801 801 501 or (+48) 22 455 14 04 (call cost according to the operator’s tariff).
- The Program shall be held from 15.04.2024 to 7.05.2024 (hereinafter referred to as the “Program Period”).
- The Program shall be conducted in the territory of the Republic of Poland.
Program Participants
- Participation in the Program is available only to adult users of tobacco or nicotine-containing products who reside in Poland and:
- register or have an Account in the consumer database of users of smoke-free products offered by PMPL-D (hereinafter referred to as the “Database”), on terms and conditions provided for in separate documents (“TERMS AND CONDITIONS OF REGISTRATION WITH THE CONSUMER DATABASE OF PHILIP MORRIS POLSKA DISTRIBUTION SP. Z O.O.”, “PL.IQOS.COM STORE AND WEBSITE TERMS AND CONDITIONS”), and;
- agree to receive commercial information from the Organiser (hereinafter referred to as the “Participants”);
§ 3
Benefits for registering Device at the time of purchase
- A Participant who fulfils the conditions described in § 2(1)(a) and (b) of the Terms and Conditions, and who, during the Program Period while making a purchase at:
a) a stationary IQOS store registers in their account, which can be accessed via the website at www.iqos.com or www.veev-vape.com, in the Database (hereinafter referred to as the “Account”), an IQOS, lil SOLID, or VEEV ONE device (hereinafter the “Device”) and an IQOS ILUMA PRIME, IQOS ILUMA, or IQOS ILUMA ONE device (hereinafter the “Device from the IQOS ILUMA family”), will receive at this stationary IQOS store:
- for IQOS 2.4 PLUS, IQOS 3 DUO, IQOS ORIGINALS DUO devices – 2 packs of HEETS tobacco sticks;
- for lil SOLID Device – 2 packs of Fiit tobacco sticks;
- for VEEV ONE Device – 2 VEEV ONE pods;
- for devices from the IQOS ILUMA family – 2 packs of TEREA or DELIA tobacco sticks;
(hereinafter referred to as “Benefits for the purchase at the IQOS store”).
b) in the case of registration of IQOS ILUMA family Devices in selected retail outlets (you can obtain information about the nearest retailer to register with the Database via the Customer Service Centre referred to above), the following will be sent to the provided telephone number:
- in the event of using the offer described in the Regulations “OFFER WITH REGISTRATION IN THE PHILIP MORRIS POLSKA DISTRIBUTION SP. Z O.O. DATABASE AND REGISTRATION OF A DEVICE FROM THE IQOS ILUMA FAMILY”:
- a text message with a code enabling the purchase of 3 packs of TEREA or DELIA tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- a text message with a code enabling the purchase of 3 packs of TEREA or DELIA tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- in the event of not using the offer described in the Regulations “OFFER WITH REGISTRATION IN THE PHILIP MORRIS POLSKA DISTRIBUTION SP. Z O.O. DATABASE AND REGISTRATION OF A DEVICE FROM THE IQOS ILUMA FAMILY”:
- a text message with a code enabling the purchase of 3 packs of TEREA or DELIA tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- a text message with a code enabling the purchase of 3 packs of TEREA or DELIA tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- SMS message with a Voucher in the amount of PLN 50 (hereinafter referred to as the “PLN 50 Voucher”), enabling the purchase of any of the available accessories (which can be placed in the Participant’s shopping cart) for Devices from the IQOS ILUMA family in the store www.iqos.com or a PLN 50 voucher enabling the purchase of any of the available accessories for Devices from the IQOS ILUMA family and/or TEREA or DELIA tobacco sticks at an IQOS stationary store. The PLN 50 voucher will work in the case of one-off purchases for an amount equal to or higher than PLN 51, in that it will reduce the price of such purchases by PLN 50; the PLN 50 Voucher cannot be combined with other offers;
(hereinafter referred to as “Benefits for the Purchase at a retail outlet”).
- During the Program Period, the Participant has the right to use the Benefits when purchasing at the IQOS store, referred to in § 3(1)(a) and (b) of the Terms and Conditions, no more than twice within 30 days from the moment of registration of the Device or Device from the IQOS ILUMA family in Database.
§ 4
Benefits for post-purchase registration
- A Participant who fulfils the conditions described in § 2(1)(a) and (b) of the Terms and Conditions, who registers in their Account, in the Database, an IQOS, lil SOLID or VEEV ONE Device and a Device from the IQOS ILUMA family, purchased on the territory of the Republic of Poland, which has not been previously a) registered at the time of purchase pursuant to § 3 of the Terms and Conditions, or b) excluded under § 5 (2) of the Terms and Conditions, and the Participant is the first owner (the device has not been registered in another Account), subject to § 5 (3) of the Terms and Conditions, in one of the following ways:
- via the website www.rejestrujemysie.pl;
- by sending a text message to 799 448 202 or 4909 with his/her name (text message cost according to the operator’s tariff); after receiving the message, the Organisers representative will contact the Participant in order to carry out the registration;
- by contacting the Customer Service Centre by phone at 801 801 501 or 22 455 14 04 or 799 448 202 (call cost according to the operator’s tariff);
- via the website www.iqos.com, www.veev-vape.com;
- by visiting an IQOS stationary store. You can obtain information about your nearest store via the Customer Service Centre referred to above or at www.iqos.com and this information is included in Appendix 1 to the Terms and Conditions;
- at selected retail outlets. You can obtain information about the nearest retailer to register with the Database via the Customer Service Centre referred to above.
Will receive, subject to paragraphs 3(1b)(i) and section 3 and 4 below, for:
- IQOS 2.4 PLUS, IQOS 3 DUO, IQOS ORIGINALS DUO Devices – a text message with a code enabling the purchase of 3 packs of HEETS tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- lil SOLID Device – a text message with a code enabling the purchase of 3 packs of Fiit tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- VEEV ONE Device – a text message with a code enabling the purchase of 4 VEEV ONE pods for the price of 2 at the place of redemption of the discount code selected according to the text message;
- Device from the IQOS ILUMA family – a text message with a code enabling the purchase of 3 packs of TEREA or DELIA tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message (hereinafter for letters (g) to (j) referred to as the “Discount Code”) and a discount code with a PLN 50 Voucher;
- The discount codes referred to in § 4 (1) (g) to (j) of the Terms and Conditions with a PLN 50 Voucher are hereinafter referred to as “Benefits after purchase”.
- In the case of registration of the Device and a Device from the IQOS ILUMA family during a meeting with an IQOS Representative, who, at the time of registration, will be present at the retail outlet in which it is possible to redeem Discount Codes, in accordance with § 4 (1) of the Terms and Conditions, the Participant will receive, subject to § 4 (1) (g), (h), (i), and (j) and section 4 of the Terms and Conditions, for:
- IQOS 2.4 PLUS, IQOS 3 DUO, IQOS ORIGINALS DUO Devices – a text message with a code enabling the purchase of 3 packs of HEETS tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- lil SOLID Device – a text message with a code enabling the purchase of 3 packs of Fiit tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message;
- VEEV ONE Device – a text message with a code enabling the purchase of 4 VEEV ONE pods for the price of 2 at the place of redemption of the discount code selected according to the text message;
- Device from the IQOS ILUMA family – a text message with a code enabling the purchase of 3 packs of TEREA or DELIA tobacco sticks for the price of 1 pack at the place of redemption of the discount code selected according to the text message.
The PLN 50 Voucher will not be awarded in the event of registering the Device as described in § 4 (3) (d) of the Terms and Conditions.
(hereinafter referred to as the “Benefits for the purchase with an IQOS Representative at a retail outlet redeeming Discount Codes”).
- In the case of registration of the Device during a meeting with an IQOS Representative, who, at the time of registration, will be present at the retail outlet in which it is not possible to redeem Discount Codes, in accordance with § 4 (1) of the Terms and Conditions, the Participant, instead of a Discount Code will receive from an IQOS Representative:
- for IQOS 2.4 PLUS, IQOS 3 DUO, IQOS ORIGINALS DUO devices – 2 packs of HEETS tobacco sticks;
- for lil SOLID Device – 2 packs of Fiit tobacco sticks;
- for VEEV ONE Device – 2 VEEV ONE pods;
- for devices from the IQOS ILUMA family – 2 packs of TEREA or DELIA tobacco sticks and a PLN 50 Voucher;
(hereinafter referred to as the “Benefits for the purchase with an IQOS Representative at a retail outlet not redeeming Discount Codes”).
§ 5
Program Limits
- During the Program Period, the Participant is entitled to use:
- Benefits for the purchase at a retail outlet;
- Post-purchase Benefits;
- Benefits for the purchase with an IQOS Representative at a retail outlet redeeming Discount Codes;
- Benefits for the purchase with an IQOS Representative at a retail outlet not redeeming Discount Codes;
- Benefits for the purchase at a retail outlet;
for each new Device or Device from the IQOS ILUMA family, but no more than twice in a period of 30 days from the moment of registration of the Device or Device from the IQOS ILUMA family in the Database.
- Benefits for the Purchase at a retail outlet, Benefits after purchase, Benefits for the purchase with an IQOS Representative at a retail outlet redeeming Discount Codes, Benefits for the purchase with an IQOS Representative at a retail outlet not redeeming Discount Codes:
- can only be used once;
- are not subject to exchange or return;
- cannot be exchanged for cash or cash equivalent;
- if they are not used within their validity period, the Participant is not entitled to a cash equivalent or any payment in cash;
- can only be used by the Program Participant. The Organizer reserves the right to verify the Participant's identity upon receipt and use of a given benefit in order to confirm participation in the Program.
- can only be used once;
- Excluded from participation in Benefits for the purchase at a retail outlet, Post-purchase Benefits, Benefits for the purchase with an IQOS Representative at a retail outlet redeeming Discount Codes, and Benefits for the purchase with an IQOS Representative at a retail outlet not redeeming Discount Codes, are Devices and Devices from the IQOS ILUMA family that were registered during purchase, including Devices and Devices from the IQOS ILUMA family purchased with such registration:
- at the website www.iqos.com, www.veev-vape.com;
- during a phone call with an IQOS representative;
- at an IQOS stationary store.
- at the website www.iqos.com, www.veev-vape.com;
- In the event of purchasing more than one Device or Devices from the IQOS ILUMA family in a stationary IQOS store as part of one transaction, understood as the simultaneous purchase of several Devices or Devices from the IQOS ILUMA family, which was recorded on one receipt, within the scope of the Program (i.e. in the case of registration of a Device after purchase), Post-purchase benefits referred to in § 4 of the Terms and Conditions are available only for registering one Device or one Device from the IQOS ILUMA family.
§ 6
Personal data protection
- The Controller of personal data of Program Participants is the Organiser.
- The processing of personal data shall take place in accordance with the rules laid down in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – “GDPR”).
- Personal data may be processed for the purpose of proper organisation and implementation of the Program, including contact with Participants on matters related to the Program, as well as for marketing purposes, which is a legitimate interest of the Organiser. Personal data will be processed for the duration of the Program and also after its completion, if it is justified by the need to settle claims or due to legal provisions.
- Providing personal data and expressing consents is voluntary, but necessary to participate in the Program.
- The Program Participant shall have the right to access the content of their data, request their rectification, deletion, restriction of processing and the right to object against their processing, as well as the right to lodge a complaint with the supervisory authority. The Program Participant also has the right to transfer personal data and in cases where the processing of data takes place based on a consent – to withdraw such consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
- The Organiser declares that the data of the Participants will not be processed in an automated manner and will not be profiled.
- The data of the Program Participants may be transferred to the Organiser’s subcontractors and entities authorised by law.
- The Organiser will collect the following data from the Participants:
- first name;
- last name;
- date of birth;
- phone number;
- e-mail address;
- postal code (optional for registration at an IQOS stationary store);
- city of residence (for online registration at www.iqos.com, www.veev-vape.com).
- first name;
- Data of Participants may be transferred to third countries (i.e. outside the European Economic Area, including the European Union, Norway, Liechtenstein, and Iceland).
- Participants may contact the Organiser if they have any questions regarding the processing of personal data by the Organiser by using the following e-mail address: contact.pl@iqos.com.
- Participants have the right to file a complaint with the supervisory authority (President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warszawa; www.uodo.gov.pl).
- More information on the protection of personal data can be found in the Privacy Policy available at https://www.pmiprivacy.com/poland/pl/consumer/.
§ 7
Complaint procedure
- The Participant shall have the right to file a complaint regarding the Program at any time.
- The Participant may file a complaint in particular in the form of an e-mail sent to contact.pl@iqos.com or by calling the Helpdesk at 801 801 501 or (+48) 22 455 14 04 (call cost according to the operator’s tariff). In order to expedite the consideration of the complaint, the Organiser recommends to provide in the complaint a brief description of the reasons justifying the complaint, contact details of the Participant filing the complaint and the note “BENEFIT FOR EXPRESSING MARKETING CONSENT TO PHILIP MORRIS POLSKA DISTRIBUTION SP. Z O.O. AND REGISTERING THE DEVICE”.
- The complaint will be handled by the Organiser within 14 days from the Organiser’s receipt of the complaint notice from the User.
§ 8
Final provisions
- All matters not provided hereunder shall be governed by the provisions of Polish law, in particular the provisions of Polish Civil Code.
- Should any provision of these Terms and Conditions prove invalid or legally ineffective, the Terms and Conditions shall remain in full force and effect with regard to the remaining provisions.
- By joining the Program, the Program Participants agree to adhere to these Terms and Conditions.
- The Organiser reserves the right to change the Terms and Conditions, including in the event of one of the following important reasons:
- any change to the legal provisions governing the principles of granting Benefits for registering Device at the time of purchase specified in § 3 of the Terms and Conditions and in § 4 of the Terms and Conditions on Benefits for post-purchase registration by the Organiser, affecting the mutual rights and obligations specified in these Terms and Conditions;
- necessity of adapting the Organiser's activities to orders, judgments, resolutions or guidelines resulting from:
- any change to the legal provisions governing the principles of granting Benefits for registering Device at the time of purchase specified in § 3 of the Terms and Conditions and in § 4 of the Terms and Conditions on Benefits for post-purchase registration by the Organiser, affecting the mutual rights and obligations specified in these Terms and Conditions;
- a decision from a public administration body competent in the scope of the Organiser's activities affecting the mutual rights and obligations specified in the Terms and Conditions, or
- a court decision applicable to the scope of the Organiser's activities affecting the mutual rights and obligations specified in the Terms and Conditions;
- occurrence of a majeure force incidents affecting the financial situation of the Organiser ( majeure force means an incidents (a) which the Organiser could not predict while observing due care required in professional relations and (b) which is external both to the Participant as well as the Organiser and (c) which the Organiser could not oppose while acting with due diligence understood in this way.
- In the event of changes to the Terms and Conditions, the Organiser shall make the consolidated text of the Terms and Conditions available in the places listed in § 1 point 2 of the Terms and Conditions.
- Any change to the Terms and Conditions does not affect the rights acquired by the user under contracts concluded until the day of introducing the change to the Terms and Conditions, unless otherwise stated from legal provisions.
- Any change to the Terms and Conditions shall be effective from the day indicated in the new terms and conditions.
